Divorce: Type & Process

Although the general idea behind divorce is the same regardless of the circumstances, there are in fact different types of divorce proceedings.   Deciding which type of divorce is best will depend on the parties involved and their ability to reach an agreement before hiring attorneys and heading to court. If you and your spouse agree on the division of property and child custody then you will likely be able to go through an uncontested divorce which is a much more quick and smooth process. Some of the other areas that often act as barriers to settlement are alimony and property division.

However, if you cannot reach an agreement then you will need to go through a contested divorce to settle those disputed issues, a contested divorce can take more time and can be very unpredictable. Although a contested divorce means the parties can’t come to an agreement on their own there is still a chance the divorce could be settled through mediation. Mediation is required in Utah and is a simple negotiation process where the parties each sit down with a mediator separately and the mediator goes back and forth between the parties trying to determine if the parties can possibly reach a settlement, thus saving time and money.
